Many groups have challenged that provision of the Foreign Intelligence Surveillance Act. The groups have argued that the provision violates the First and Fourth Amendment. The new provisions require the groups to take measures to protect the confidentiality of their international communications. Southern District of New York said that did not have the standing in bringing forth their challenge. The groups had a fear of being monitored.
I believe that those groups that challenged the had the groups had their right to challenge the provisions. The provisions violate their first amendments rights because they have the freedom to speech and anything that they want. the provisions takes that away because they have to take extra measures to protect themselves. It also violates the fourth amendment because if they are being watched there is no warrant given to them. it is something that they have to live with because they are under the FISA.
