Worth the Trouble?

November 4th, 2012

I believe that the United States should avoid cases like Kiobel v. Royal Dutch Petroleum. The main reason I believe this is because there are not enough similar cases. In order for it to be worth the time and financial expense required to hear a case in the Supreme Court, there needs to be a significant amount of similar cases. Kiobel v. Royal Dutch Petroleum is just not relevant enough to be worth it. Another reason why I believe the United States should avoid cases like Kiobel v. Royal Dutch Petroleum is because there is a potential for undesirable consequences that could result from a hearing. The United States certainly does not want to damage relations with other countries based on the outcome of one Court hearing. For example, should the Court rule in favor of the respondent in this particular case, what consequences come of that? Perhaps none, but it is not worth the risk.
